End User Licence Agreement
Effective 13 October 2026
This End User Licence Agreement (“Licence”) is between you and VPT (“we”, “us”), the provider named at the end of this page. It governs your use of the VPT app (listed on the App Store as “Virtual PT”). Your use of the services behind the app is also governed by our Terms of Service and our Privacy Policy.
1. Acknowledgement
This Licence is between you and us only, not Apple Inc. (“Apple”). We, not Apple, are solely responsible for the app and its content.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app for your own personal, non-commercial purposes. You may use it on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, distribute, sell, rent or lease the app. You may not reverse engineer it or try to derive its source code, except as the law expressly permits.
3. Maintenance and support
We, not Apple, are solely responsible for maintenance and support of the app. Contact support@vpt.info. Apple has no obligation to provide maintenance or support for the app.
4. Warranty
To the extent permitted by law, the app is provided “as is”. If the app fails to conform to any warranty that applies to it, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation at all with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent the law does not exclude them. Nothing in this Licence limits your rights under the Australian Consumer Law or other consumer protection laws that cannot be excluded.
5. Product claims
We, not Apple, are responsible for addressing any claims by you or a third party relating to the app, or to your possession or use of it. This includes:
- product liability claims;
- claims that the app fails to conform to a legal or regulatory requirement; and
- claims arising under consumer protection, privacy or similar laws, including in connection with the app’s use of HealthKit.
6. Intellectual property
If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
7. Legal compliance
You represent and warrant that:
- you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and
- you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Third-party terms
You must comply with any applicable third-party terms when using the app, such as the terms of your wireless data provider.
9. Third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of this Licence. Once you accept this Licence, Apple has the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.
10. Termination
This Licence applies until you or we end it. It ends automatically if you fail to comply with it. When it ends you must stop using the app and delete it.
11. Changes
We may update this Licence. We will update the effective date above, and ask you to accept material changes in the app.
12. Governing law
This Licence is governed by the laws of New South Wales, Australia.
